Lunch DIScussions: Swiss Rules for Corporate Disputes – A Model for Germany?
10 April 2025, Online

Corporate disputes are often also heard by arbitral tribunals. While the DIS has developed its own rules for such disputes, Germany lacks any legal regulation. It is therefore still unclear, for example, whether arbitration clauses can also be included in the articles of association of stock corporations and whether they can always only be adopted unanimously.

Switzerland, on the other hand, has introduced a legal regulation for corporate disputes as of 1 January 2023 that explicitly addresses these and other issues.

We would therefore like to discuss with you whether and to what extent the new Swiss rules could also be a model for Germany. Irma Ambauen, Eileen Loebig, and Philipp Massari will discuss the topic, with Alice Broichmann as the moderator.
